Article 1 "In order to prevent the introduction of infectious diseases from abroad or from the country, implement border health and quarantine, and protect human health, this law is enacted.
Article 2 Frontier health and quarantine offices shall be established at the ports, airports, land borders and border river ports of the People’s Republic of China for international navigation (hereinafter referred to as border ports) to implement infectious disease quarantine, monitoring and health supervision in accordance with the provisions of this law.
Article 3 The infectious diseases stipulated in this law refer to quarantine infectious diseases and surveillance infectious diseases.
Quarantine infectious diseases refer to plague, cholera, yellow fever, and other infectious diseases determined and announced by the State Council. The monitoring of infectious diseases shall be determined and announced by the health administration department of the State Council.
Article 4 "People, vehicles, transportation equipment, luggage, goods, postal parcels and other items that may spread quarantine infectious diseases shall be subject to quarantine, and they shall be allowed to enter or leave the country with the permission of the frontier health and quarantine agency. The specific measures shall be stipulated in the implementation rules of this law.
Article 5 When the frontier health and quarantine agency discovers a quarantine infectious disease or a suspected quarantine infectious disease, it must immediately notify the local health administration department in addition to taking necessary measures, and at the same time, use the fastest method to report to the health administration department under the State Council, and it shall not exceed 20% at the latest. Four hours. The post and telecommunications departments shall give priority to the transmission of epidemic reports. The notification of the epidemic situation of infectious diseases between the People's Republic of China and foreign countries shall be handled by the health administration department of the State Council in conjunction with relevant departments.
Article 6: When a quarantine infectious disease is pandemic abroad or at home, the State Council may order the blockade of relevant borders or take other emergency measures.
Chapter Two Inspection Epidemic
Article 7 The means of transportation and personnel entering the country must be quarantined at the designated place at the first frontier port of arrival. Except for the pilot, no one is allowed to get on and off the vehicle without the permission of the frontier health and quarantine agency, and no one is allowed to load or unload luggage, cargo, parcels and other items. The specific measures shall be stipulated in the implementation rules of this law.
Article 8 Vehicles and personnel leaving the country must be quarantined at the last frontier port of departure.
Article 9: When a ship or aircraft from a foreign country berths or lands at a non-port point in China for some reason, the person in charge of the ship or aircraft shall immediately report to the nearest frontier health and quarantine agency or the local health administrative department. Except for emergencies, no one is allowed to disembark or disembark ships or aircraft, or load or unload luggage, cargo, parcels and other items without the permission of the frontier health and quarantine agency or the local health administrative department.
Article 10 Where a quarantine infectious disease or a suspected quarantine infectious disease is found at a frontier port, or someone dies without accidental injury and the cause of death is unknown, the person in charge of the relevant unit and transportation at the frontier port shall immediately report it to the frontier health and quarantine agency, and Apply for temporary quarantine.
Article 11: According to the quarantine results provided by the quarantine physician, the frontier health and quarantine office shall issue an entry quarantine certificate or an exit quarantine certificate for vehicles that are not infected with quarantine infectious diseases or have been sanitized.
Article 12 The frontier health and quarantine agency must immediately isolate a person infected with a quarantine infectious disease, and the isolation period shall be determined based on the results of medical examination; for a suspect infected with a quarantine infectious disease, they shall be detained for inspection, and the period of detention shall be based on the infectious disease. The incubation period is determined. The corpses that died of quarantine infectious diseases must be cremated nearby.
Article 13 The transportation vehicles that are subject to entry quarantine shall undergo disinfection, deratization, deworming or other sanitary treatments:
(1) Coming from a quarantine infectious disease area;
(2) Contaminated by quarantine infectious diseases;
(3) Rodents or vector insects related to human health are found.
If the person in charge of a foreign vehicle refuses to accept sanitation treatment, except under special circumstances, the vehicle is allowed to leave the border of the People’s Republic of China immediately under the supervision of the frontier health and quarantine agency.
Article 14 The frontier health and quarantine agency shall conduct sanitary inspections and implement disinfection, deratization and deworming of luggage, goods, postal parcels and other items that come from epidemic areas, are contaminated by quarantine infectious diseases, or may become the vectors of quarantine infectious diseases. Or other sanitary treatment. The shipper or his agent of the corpses and bones entering or leaving the country must declare to the frontier health and quarantine agency, and only after passing the sanitary inspection can they be transported in or out.
Chapter Three Infectious Disease Surveillance
Article 15 The frontier health and quarantine agency shall monitor people entering and leaving the country for infectious diseases, and take necessary preventive and control measures.
Article 16 The frontier health and quarantine office has the right to require persons entering or leaving the country to fill in a health declaration card and present a vaccination certificate, health certificate or other relevant documents for certain infectious diseases.
Article 17: For people suffering from surveillance infectious diseases, people from areas where surveillance infectious diseases are endemic, or people in close contact with surveillance infectious patients, the frontier health and quarantine office shall distinguish the situation, issue a convenient card for medical treatment, carry out detention for inspection or Take other preventive and control measures, and notify the local health administrative department in time. Medical units in various regions shall give priority to diagnosis and treatment of persons who hold convenient cards for medical treatment.
Chapter 4 Sanitary Supervision
Article 18: The frontier health and quarantine agency shall, in accordance with the sanitary standards prescribed by the state, implement sanitary supervision on the sanitary conditions of the frontier ports and the sanitary conditions of the vehicles entering or leaving the country at the frontier ports:
(1) Supervise and guide relevant personnel in the prevention and control of rodents and vector insects;
(2) Inspecting and inspecting food, drinking water and their storage, supply, and transportation facilities;
(3) Supervise the health status of employees engaged in the supply of food and drinking water, and check their health certificates;
(4) Supervise and inspect the treatment of garbage, waste, sewage, feces, and ballast water.
Article 19: The frontier health and quarantine agency shall set up frontier port health supervisors to perform the tasks assigned by the frontier health and quarantine agency. When performing their tasks, frontier port health inspectors have the right to conduct health supervision and technical guidance on frontier ports and the means of transport entering and exiting the country, put forward suggestions for improvement of poor health conditions and factors that may cause the spread of infectious diseases, and coordinate with relevant departments to take necessary measures. Chapter V Legal Responsibilities
Article 20: For units or individuals that violate the provisions of this law and commit one of the following acts, the frontier health and quarantine agency may issue a warning or fine according to the seriousness of the circumstances:
(1) To evade quarantine and conceal the true situation from the frontier health and quarantine agency;
(2) Persons entering China, without the permission of the frontier health and quarantine agency, get on and off vehicles, or load and unload luggage, goods, postal parcels and other items, and refuse to listen to dissuasion.
All fines shall be turned over to the state treasury.
Article 21: If the party concerned is dissatisfied with the decision on the fine imposed by the frontier health and quarantine agency, he may file a lawsuit in the local people's court within fifteen days from the date of receiving the notification. If neither the prosecution nor the performance is fulfilled within the time limit, the frontier health and quarantine agency may apply to the people’s court for compulsory enforcement.
Article 22: Anyone who violates the provisions of this law and causes the spread of quarantine infectious diseases or has a serious risk of causing the spread of quarantine infectious diseases shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law.
Article 23 The staff of the frontier health and quarantine agency shall enforce the law impartially, be loyal to their duties, and promptly conduct quarantine on the means of transport and personnel entering or exiting the country; those who violate the law and neglect their duties shall be given administrative sanctions; if the circumstances are serious enough to constitute a crime, they shall be investigated for criminal offences in accordance with the law. responsibility.

Article 24: Where the international health and quarantine treaties concluded or acceded by the People's Republic of China have different provisions from this law, the provisions of the international treaties shall apply. However, the terms reserved by the People’s Republic of China are excluded.
Article 25 The exchanges between the border defense agencies of the People’s Republic of China and the border defense agencies of neighboring countries in the border areas, temporary exchanges between residents living in the border areas of the two countries in designated border areas, and the entry and exit of vehicles and personnel from both sides Quarantine shall be handled in accordance with the agreement between the two parties. If there is no agreement, it shall be handled in accordance with the relevant regulations of the Chinese government.
Article 26: The frontier health and quarantine agency shall conduct health and quarantine and collect fees in accordance with state regulations.
Article 27: This law shall come into force on May 1, 1987. The "Regulations of the People's Republic of China on Frontier Health and Quarantine" promulgated on December 23, 1957 shall be repealed simultaneously.
